These Terms and Conditions (“Terms”) govern your access to and use of the website located at https://homeritejacksonville.com (the “Site”) and all related services, including but not limited to requesting quotes, scheduling consultations, receiving communications, and interacting with HomeRite™ Windows & Doors of Jacksonville (“HomeRite,” “we,” “us,” or “our”).

By accessing or using the Site, submitting any form, providing your contact information (including phone number), or receiving any communications from us (including SMS/text messages), you agree to be bound by these Terms. If you do not agree, do not use the Site or provide your information.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and HomeRite. Your continued use of the Site or acceptance of communications constitutes acceptance of these Terms and any future modifications.

2. Our Services

HomeRite provides professional sales, installation, and repair of energy-efficient windows, entry doors, patio doors, and related products for residential and commercial customers in Northeast Florida (primarily Duval, St. Johns, Clay, Nassau, Baker, and Putnam counties). All services are subject to separate written agreements, estimates, and contracts.

3. Intellectual Property

All content on the Site—including text, images, logos, designs, videos, and software—is owned by or licensed to HomeRite and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

4. User Submissions and Lead Information

When you submit a form (e.g., for a free in-home consultation, quote request, or contact), you represent that all information provided is accurate and complete. You grant HomeRite a non-exclusive, royalty-free license to use, store, and process this information to respond to your inquiry, provide services, and for internal business purposes.

We may use third-party customer relationship management software (including Builder Prime CRM) to manage leads, communications, and customer interactions.

5. SMS and Text Messaging Program (Critical for Builder Prime SMS Integration)

HomeRite offers an SMS/text messaging program to deliver important updates, appointment reminders, project status notifications, installation scheduling, follow-up communications, promotional offers, and service-related information.

By providing your mobile phone number on any form on this Site, checking a consent box, or otherwise affirmatively opting in, you expressly consent to receive SMS/text messages from HomeRite at that number.

Key SMS Terms (as required for Builder Prime SMS capability):

  • Consent & Purpose: You consent to receive both transactional (e.g., appointment confirmations, order/project updates) and marketing/promotional SMS messages from HomeRite. Consent is not a condition of any purchase or service.
  • Message Frequency: Message frequency varies depending on your interactions with us and the status of your project or inquiry (typically several messages per project lifecycle).
  • Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message from us. We will process your opt-out request promptly and cease sending future messages (except for a one-time confirmation). You may also opt out by calling us at (904) 474-3882 or emailing [email protected].
  • Help: Reply HELP to any message for assistance or additional information.
  • Costs: Standard message and data rates may apply. HomeRite does not charge fees for SMS messages. Check with your wireless carrier for details.
  • Eligibility: You must be the authorized user of the mobile number provided and at least 18 years of age (or have parental/guardian consent).
  • Compliance: We comply with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, Florida state laws, and all applicable regulations. We maintain records of your consent. We honor the National Do Not Call Registry and will only contact numbers with proper prior express written consent or an established business relationship.
  • Program Changes: We may modify or discontinue the SMS program at any time. Material changes will be communicated via the Site or SMS.

Example Opt-In Language Used on Our Forms (for your reference when submitting information): “By clicking Submit / checking this box, you agree to HomeRite’s Terms and Conditions and Privacy Policy. You consent to receive phone calls and SMS/text messages from HomeRite to provide updates on your inquiry/order/project and/or for marketing purposes. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help.”

Your consent applies to HomeRite and our authorized service providers (including our CRM platform, Builder Prime). We do not sell or share your phone number for third-party marketing without your separate consent.

6. Privacy Policy

We are committed to protecting your personal information. Our collection, use, and disclosure of data (including phone numbers collected for SMS) is governed by our separate Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully. A link to the current Privacy Policy will be provided on the Site and in all opt-in language.

7. Limitation of Liability

To the fullest extent permitted by law, HomeRite shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, our services, or SMS communications, including but not limited to lost profits, data loss, or personal injury. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless HomeRite, its owners, employees, agents, and partners from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, violation of these Terms, or provision of inaccurate information.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Duval County, Florida. You consent to personal jurisdiction in those courts.

10. Modifications to Terms

We reserve the right to update these Terms at any time. The “Last Updated” date will reflect changes. Continued use of the Site or acceptance of communications after changes constitutes acceptance of the revised Terms.
